[With the approval of the Organic Law 2/2010, of March 3, on sexual and reproductive health and voluntary interruption of pregnancy, a series of measures involving the educational sphere in the area of sexuality were set out. It was this point that aroused my interest in knowing what was really being developed through this law, and this question led me to investigate what is specified in the current Education Law in terms of sex education.

The need was perceived to know how this type of instruction was in the Bologna Plan degrees, the fact that new curricula are proposed, would mean that they would be more updated as far as sex education is concerned, because from these degrees will come out educated professionals who should impart a series of knowledge to boys and girls in this area.  [With the passage of the Organic Law 2 / 2010 of March 3, sexual and reproductive health and abortion, put forward a series of measures involving the realm of education in the aspect of sexuality. It was this point that I raised the interest in knowing what was really being developed through this law, and that question led to research what is specified in the current Law on Education regarding sexual education .

La Ley Orgánica 2/2010, de 3 de marzo, regula, entre otras, las condiciones de la interrupción voluntaria del embarazo y las garantías en el acceso a la prestación y la diferencia entre la Interrupción del embarazo a petición de la mujer y la Interrupción por causas médicas:

El embarazo podrá interrumpirse dentro de las primeras 14 semanas de gestación, siempre que se cumplan los siguientes requisitos:1) Que la mujer embarazada haya sido informada de los derechos, prestaciones y ayudas públicas de apoyo a la maternidad, en los términos establecidos en los apartados 2 y 4 del artículo 17 de esta Ley.2) Que haya transcurrido un plazo mínimo de tres días, desde la información mencionada en el apartado anterior y la realización de la intervención.

Excepcionalmente, se podrá interrumpir el embarazo cuando concurra alguna de las siguientes circunstancias:Art. 15a) Que no se superen las 22 semanas de gestación y siempre que exista un grave riesgo para la vida o la salud de la embarazada y así se acredite en un dictamen emitido con anterioridad a la intervención por un médico o médico especialista distinto del que ejerce o dirige la práctica. En caso de urgencia por riesgo vital para la gestante, se podrá prescindir del dictamen.Art. 15b) Que no se superen las 22 semanas de gestación y siempre que exista riesgo de anomalías graves en el feto y así conste en un dictamen emitido con anterioridad a la intervención por dos médicos especialistas distintos del que la practique o dirija.Art. 15c) Cuando se detecten anomalías fetales incompatibles con la vida y así conste en un dictamen emitido previamente por un médico o especialista, distinto del que practica la intervención, o cuando se detecte una enfermedad extremadamente grave e incurable en el feto en el momento del diagnóstico y se confirme por un comité clínico.

The Law addresses the protection and guarantee of sexual and reproductive health rights in a comprehensive manner. It introduces into our legislation the World Health Organization’s definitions of health, sexual health and reproductive health and provides for the adoption of a set of actions and measures in both the health and educational fields. It also establishes a new regulation of voluntary termination of pregnancy outside the Penal Code which, following the most widespread pattern in the countries of our political and cultural environment, seeks to guarantee and adequately protect the rights and interests of women and prenatal life.

The first duty of the legislator is to adapt the Law to the values of the society whose relations it has to regulate, always trying that the normative innovation generates certainty and security in the people to whom it is destined, since freedom only finds refuge in the firm ground of the clarity and precision of the Law. This is the spirit that inspires the new regulation of the voluntary interruption of pregnancy.

ORDER of September 17, 2021 amending the Order of October 21, 2019 by which, under the provisions of Article 16.3 of Organic Law 2/2010, of March 3, on sexual and reproductive health and voluntary termination of pregnancy, two clinical committees are established in the Autonomous Community of Galicia and their composition, constitution, operating regime and coordination are regulated.

The Organic Law 2/2010, of March 3, on sexual and reproductive health and the voluntary interruption of pregnancy, establishes in article 15.c), regarding the second case of voluntary interruption of pregnancy, that, exceptionally, a pregnancy can be interrupted for medical reasons when an extremely serious and incurable disease is detected in the fetus at the time of its diagnosis and this is confirmed by a clinical committee.

The committee will be formed by a multidisciplinary team composed of two physicians specialized in gynecology and obstetrics or experts in prenatal diagnosis and a pediatrician, and the woman will be able to choose one of these specialists.
